Preamble

WHEREAS eLawyers.pk operates a professional discovery and connection platform for legal services in Pakistan;

AND WHEREAS Users wish to access directory, verification, communication, and related facilities subject to the conditions set out herein;

NOW, THEREFORE, in consideration of the mutual covenants contained in these Terms, the parties agree as follows.

Article 1

Acceptance of Terms

  1. 1.1

These Terms of Use (the “Terms”) constitute a legally binding agreement between you (“you” or “User”) and the operator of eLawyers.pk (the “Platform”, “we”, “us”, or “our”). By accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Legal Disclaimer, which are incorporated herein by reference.

  2. 1.2

If you do not agree to these Terms in their entirety, you must immediately discontinue all use of the Platform.

  3. 1.3

These Terms apply to all Users, including visitors, registered clients, advocates, firm representatives, verification officers, and any other person who accesses the Platform.

Article 2

Definitions and Interpretation

  1. 2.1

Platform. means the website, applications, APIs, and related services operated under eLawyers.pk, including directory, verification, inquiry, messaging, appointment, and document features.

  2. 2.2

Advocate. means a legal practitioner registered on the Platform who holds, or purports to hold, a licence to practise before the courts of Pakistan.

  3. 2.3

Client. means a User seeking to discover, contact, or engage an Advocate or law firm through the Platform.

  4. 2.4

Content. means text, images, documents, credentials, messages, and other materials submitted to or displayed on the Platform.

  5. 2.5

Headings are for convenience only and shall not affect interpretation. Words importing the singular include the plural and vice versa. References to “including” mean “including without limitation”.

Article 3

Nature of the Platform

  1. 3.1

The Platform is a technology intermediary that facilitates discovery of and communication with legal professionals in Pakistan. It provides tools for directory listings, credential verification workflows, consultation inquiries, messaging, appointments, and related document exchange.

  2. 3.2

eLawyers.pk is not a law firm, chambers, legal practice, or bar association. We do not practise law, do not employ Advocates to represent Users, and do not form an advocate–client (or solicitor–client) relationship on your behalf through the mere use of the Platform.

  3. 3.3

Any retainer, engagement letter, advice, representation, or professional relationship arises solely between the Client and the Advocate or firm instructed. Fees for legal services, if any, are a matter between those parties unless expressly stated otherwise in a separate written agreement with us.

  4. 3.4

Nothing on the Platform constitutes legal advice, a legal opinion, or a guarantee of any case outcome, strategy, or timeline.

Article 4

Eligibility and Accounts

  1. 4.1

You represent that you have legal capacity to enter into these Terms. Where you act on behalf of an organisation, you represent that you are duly authorised to bind that organisation.

  2. 4.2

You shall provide true, accurate, current, and complete information when registering or updating an account, and shall maintain the confidentiality of your login credentials. You are responsible for all activity occurring under your account.

  3. 4.3

Client accounts are intended for persons seeking legal assistance. Advocate accounts are intended for licensed Advocates (and, where permitted, authorised firm staff) who satisfy our registration and verification requirements.

  4. 4.4

We reserve the right, at our sole discretion, to refuse registration, suspend access, require reverification, or terminate an account where information is false or incomplete, credentials cannot be verified, professional standing is in doubt, or these Terms are breached.

Article 5

Listings, Credentials, and Verification

  1. 5.1

Profiles and listings are submitted by Advocates or their authorised representatives. Verification marks and badges reflect Platform checks of identity, bar enrolment, office particulars, and related credentials as at the time of review.

  2. 5.2

Verification does not constitute an endorsement of an Advocate’s competence, integrity beyond the checks performed, strategy, fee arrangements, or suitability for any particular matter. Users must conduct independent due diligence before instructing counsel.

  3. 5.3

We do not warrant that listings are complete, current, or free from error. Advocates remain responsible for the accuracy of Content they submit and for promptly updating material changes to credentials, contact details, or professional status.

Article 6

Inquiries, Messaging, Appointments, and Documents

  1. 6.1

Consultation requests, messages, appointments, and document uploads are facilities to enable contact and coordination. Transmission of information through the Platform does not, by itself, create a professional retainer or privilege.

  2. 6.2

Users shall not upload unlawful material, documents belonging to third parties without authority, malware, or Content that is unnecessary for the stated purpose. Access to private documents is restricted to authorised parties under our access controls; you remain solely responsible for the Content you elect to disclose.

  3. 6.3

Advocates remain responsible for conflicts checks, confidentiality, professional conduct, and client communications in accordance with applicable laws and rules of professional practice.

  4. 6.4

We may retain logs and Content as required for security, dispute resolution, legal compliance, and Platform operation, subject to our Privacy Policy.

Article 7

Acceptable Use and Prohibited Conduct

  1. 7.1

You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms and all applicable laws of Pakistan.

  2. 7.2

Without limitation, you shall not: (a) scrape, harvest, or systematically extract personal data; (b) misrepresent your identity, qualifications, or authority; (c) interfere with the security, integrity, or availability of the Platform; (d) transmit spam, malware, or unlawful Content; (e) harass, defraud, or abuse other Users; or (f) circumvent verification, access controls, or rate limits.

  3. 7.3

We may remove Content, restrict features, suspend accounts, or take other remedial action where we reasonably believe misuse, fraud, or breach has occurred or is threatened.

Article 8

Intellectual Property

  1. 8.1

The Platform’s software, design, trademarks, trade dress, compilation of listings (excluding User-owned Content), and original materials are owned by us or our licensors and are protected by applicable intellectual property laws.

  2. 8.2

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purposes. No other licence is granted by implication or otherwise.

  3. 8.3

You retain ownership of Content you lawfully submit. By submitting Content, you grant us a worldwide, royalty-free licence to host, store, reproduce, display, and process such Content solely as necessary to operate, secure, and improve the Platform and to comply with law.

Article 9

Disclaimers of Warranty

  1. 9.1

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

  2. 9.2

We do not warrant that the Platform will be uninterrupted, secure, or error-free; that defects will be corrected; or that directory information, verification status, or User Content will be accurate or complete.

  3. 9.3

Urgent legal matters — including arrests, injunctions, limitation periods, and court deadlines — require immediate assistance from qualified counsel outside the Platform. Do not rely on the Platform for emergency legal response.

Article 10

Limitation of Liability

  1. 10.1

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or related to your use of the Platform.

  2. 10.2

Without limiting the foregoing, we are not liable for: (a) advice, acts, or omissions of Advocates or firms; (b) outcomes of legal proceedings or transactions; (c) reliance on directory or verification information; or (d) unauthorised access resulting from your failure to safeguard credentials, except to the extent caused by our wilful misconduct.

  3. 10.3

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the laws of Pakistan.

Article 11

Indemnity

  1. 11.1

You agree to indemnify, defend, and hold harmless eLawyers.pk and its officers, employees, and agents from and against claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your Content, or your misuse of the Platform, except to the extent caused by our gross negligence or wilful misconduct.

Article 12

Amendments, Suspension, and Termination

  1. 12.1

We may amend these Terms from time to time. The updated instrument will be published on this page with a revised effective or last-updated date. Material changes take effect upon posting, or on such later date as we may specify. Continued use of the Platform after the effective date constitutes acceptance of the amended Terms.

  2. 12.2

You may cease using the Platform at any time. We may suspend, restrict, or discontinue features, or terminate access, where reasonably necessary for security, legal compliance, operational integrity, or enforcement of these Terms.

  3. 12.3

Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) shall survive.

Article 13

Governing Law and Dispute Resolution

  1. 13.1

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles.

  2. 13.2

Subject to any mandatory rights that cannot be waived, the courts of competent jurisdiction in Pakistan shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Platform.

  3. 13.3

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right shall not constitute a waiver of that right.

Article 14

Notices and Contact

  1. 14.1

Formal notices under these Terms may be sent by email to legal@elawyers.pk, or to such other address as we may publish on the Platform. We may provide notices to you via the email associated with your account, in-Platform notifications, or by posting on this page.

  2. 14.2

Questions concerning these Terms should be directed to legal@elawyers.pk. Operational support requests may be sent to support@elawyers.pk.
